It not bad beat. Bad beat it when four of a Kind on four of a Kind and above converge. For example 7777 vs 3333. It bad beat.

Once I saw deal when 2,3,4,5 in diamonds were on the table, and hole cards:
pair of Aces including of diamond vs pair of sixes including of diamond!
